Uluslararası barış ve güvenliği tehdit eden sorunlarda kuvvet kullanma : Nato’nun Kosova müdahalesi örneği

Abstract

Uluslararası hukukta kuvvet kullanma ve kuvvet kullanmanın hangi kurum veya aktör tarafından nasıl ve ne şekilde gerçekleşeceği geçmişten günümüze tartışılagelen konulardan birisi olmuştur. Bu çalışmada, uluslararası hukukta kuvvet kullanmanın geçmiş çağlardan günümüze nasıl gerçekleştiği, hangi durumlarda yasak veya meşru olduğu incelenmiştir. Kuvvet kullanma konusunda temel normları düzenleyen BM örgütünün kuvvet kullanmaya bakışına örnek olaylar üzerinden kısaca değinilip, örgütün kuvvet kullanmayı düzenleyen hükümleri analiz edilmiştir. BM, uluslararası barış ve güvenliği tehdit eden ve taraflar arasında meydana gelebilecek uyuşmazlıkların çözümü hususunda, kuvvet kullanma görevini, NATO gibi askeri ittifaklara devretmiştir. Bu bağlamda, uluslararası bir savunma ittifakı olan NATO, BM Güvenlik Konseyi’nin verdiği yetki sayesinde kuvvet kullanabilmektedir. Bu çalışmada, ayrıca, NATO’nun kuruluşu ve genel yapısı incelenmiş, kuvvet kullanma bağlamında BM Güvenlik Konseyi ile ilişkisi ele alınmış, NATO’nun Soğuk Savaş öncesi ve Soğuk Savaş sonrasında izlemiş olduğu stratejik konsepte değinilmiştir. Ayrıca Soğuk Savaş dönemi sonrası Sovyetler Birliği’nin dağılması neticesinde varlığı tartışılan ittifakın, bünyesine yeni üyeler katarak gerçekleştirdiği genişleme süreci ve ittifakın alan dışı faaliyetleri incelenmiştir. Soğuk Savaş sonrası dönemde, Balkanlarda, Sovyetler Birliği’nin dağılmasını takiben oluşan süreçte, etnik çatışmalar ve ülkelerin bağımsızlık mücadeleleri sonucunda bir kaos ortamı meydana gelmiştir. Kosova’da 1999 yılında yaşananlar da bu kaosun bir sonucudur. Değişen uluslararası sistemde, NATO, Yugoslavya Federal Hükümeti’nin sebep olduğu insani drama son vermek için Kosova’ya müdahalede bulunmuştur. NATO’nun Kosova’ya müdahalesinin, uluslararası sistemde güvenlik anlayışına nasıl etki ettiği ve bu müdahalenin uluslararası hukuka aykırı olup olmadığı meselesi incelenmiş ve NATO’nun güvenlik anlayışında günümüze kadar geçirdiği evreler de analiz edilmiştir.

The use of force in international law, and by which institution or actor, and how and in what way the use of force will take place, is one of the discussed issues from the past to present. In this study, how the use of force in international law occurs from ancient times to the present day, and in which cases the use of force is prohibited or legitimate, were investigated. The view of The UN organization, which regulates fundamental norms about the use of force, and its regulated rules about it, were analyzed by referring examples briefly. UN assigned the use of force duty to military alliances as like NATO to the solution of threatening international peace and security between parties from the aspect of disputes that may occur. Concardantly, NATO, which is an international defense alliance, can use force thanks to the given authority from The UN Security Council. In this study, also, the establishment and the general structure of the NATO have been examined, and its relation with the The UN Security Council has been handled in the context of the use of force, and also NATO’s strategic concept, which is followed in the pre and post Cold War, has been mentioned. Besides, the enlargement process of the alliance, which its existence discussed as a result of the dissolution of The Soviet Union, and the off-site activities of this alliance have been investigated. A chaos enironment occured as a result of the ethnic identity conflicts and the independence struggles after the Cold War in the Balkans following the breakup period of The Soviet Union. What happened in Kosovo is a result of this chaos in 1999. NATO decided to put an end to the humanitarian tragedy performed by The Federal Yugoslavian Goverment in Kosovo according to the changes in the international system. How the intervention of NATO’s in Kosovo changed the concept of security understanding in the international system, and whether this intervention was against to international law has been examined, and the phases of the security understanding of the NATO were analyzed from the past to the present as well.
