Vergi mahremiyeti kişilere ait sır niteliğindeki bilgilerin vergilendirme süreci
boyunca ve sonrasında korunmasını amaçlamaktadır. Öyle ki bu mahremiyet sadece
vergilendirme sürecinde değil yargılama aşamasında da korunması gereken bir
mahremiyettir. Bundan dolayı vergi mahremiyetinin özel hayatın gizliliği ile çok
yakın bir ilişkisi vardır. Tüm bu özellikleri nedeniyle vergi mahremiyetinin
sınırlarının dikkatli bir şekilde çizilmesi gerekir.
Bu tez çalışmasının birinci amacı vergi mahremiyetinin temel hak ve
özgürlükler karşısındaki konumunu tespit etmeye çalışmaktır. Bu amaç kapsamında
kişinin özel hayat alanları ayrıntılı olarak incelenmiş ve vergi mahremiyetinin özel
hayat alanları içerisindeki yeri tespit edilmiştir. Çalışmanın ikinci ve asli amacı ise
vergi mahremiyetinin hukuki sınırlarını ortaya koymaktır. Bu anlamda vergi
mahremiyetinin vergi denetimi, yargılama aşaması, bankacılık işlemleri, bilgi
paylaşımı ve suç gelirlerinin aklanması konuları bakımından anayasal sınırları tespit
edilmeye çalışılmıştır. Çalışmamızda vergi mahremiyeti ile ilgili tüm bu sorunlar
insan hakları ve anayasa hukuku bakımından ele alınarak konuyla ilgili literatüre
katkı sağlanması hedeflenmiştir.
Tax privacy aims to protect the information belonging to individuals which
has glaze qualification during taxation process and after. And this privacy is not only
a privacy which should be protected during the taxation process but also a privacy
which should be protected during the trial process. Therefore, tax privacy has an
intimate relationship with the right of privacy. Because of all its features, the
limitation of secrecy of taxes should be drawn rigorously.
The first aim of this study is to determine the position of tax privacy against
of fundamental rights and freedoms. Within the scope of this aim, one's privacy life
areas are examined detailed and the place of tax privacy within privacy life areas are
determined. The second and fundamental aim of the study is put forth the legal
limitation of tax privacy. In this sense, it is tried to determine constitutional
limitations of tax privacy in terms of tax auditing, trial process, banking transactions,
information sharing, and laundering of crime revenues. In our study, it is aimed to
contribute to the literature by considering all these problems concerning to tax
privacy in terms of human rights and constitutional law.
