Tarih yıllar boyunca korkunç suçlara tanık olmuĢ ve hak ihlalleri karĢısında yeteri kadar adaleti sağlayamamıĢtır. Soğuk SavaĢ dönemi ile birlikte 50 yıllık pasif bir süreçten sonra 160 ülkenin katılımı ile beraber ilk daimi mahkeme kurulmuĢtur. Uluslararası Ceza Mahkemesi (UCM) 20. yüzyılın sonunda kurulmuĢ ve daha çok 21. yüzyılda etkili olan ortak küresel taahhüdün bir ürünüdür.
Ġkinci Dünya SavaĢı ile birlikte Nuremberg ve Tokyo Mahkemeleri kurularak sistemde bir örnek oluĢturulmuĢtur. “uluslararası” bir ceza mahkemesi olmasından dolayı çok büyük önem taĢımaktadır. Uluslararası sistemdeki değiĢik bölgesel güçlerin varlığı, sistemde tüm devletlerin uyacağı ortak evrensel hukuk çerçevesine uyup uymamalarından kaynaklanan denge rejimi için Uluslararası Ceza Mahkemesi gerekli ve önemli bir organdır.
Özellikle 21.Yüzyılda insan haklarının daha çok sorgulanmaya baĢlanması ile insanlığa karĢı suçların yargılanması talepleri uluslararası toplulukta artmıĢ bu durum dolaylı yoldan UCM‟yi baĢvurulacak önemli bir organ kılmıĢtır. Dolayısı ile birçok farklı bölgesel devletin bir arada aynı anarĢik sistem altında gerek hükümetler arası gerek uluslararası örgütler çerçevesinde sağlamaya çalıĢtıkları bu düzende UCM caydırıcılık rolü üstlenmeyi amaç edinmiĢtir.
Özellikle Kuvvet Kullanma olgusunun 1990‟larda uluslararası sistemde yetersiz kalmasıyla 2000‟li yıllarda acil müdahalenin kapısını açacak, yani BirleĢmiĢ Milletler Güvenlik Konseyi‟nin iznine gerek duymadan müdahale yolunu açan ve uluslararası hukukta egemenlik kavramına yeni bir anlam katan Koruma Sorumluluğu olgusu ortaya çıkarılmıĢtır. Diğer bir deyiĢle, yapılan insani müdahalenin BMGK izni olmadan meĢrulaĢtırılması durumu ortaya çıkmaktadır.
UCM bu doğrultuda üstlendiği rol ile Koruma Sorumluluğu olgusunu bağımsız bir ceza mahkemesi olarak devletlerin vatandaĢlarını korumasında etkili bir rol oynamayı amaçlamıĢtır. Devletler Hukuku ve uluslararası anlaĢmalarda somut bir bağlayıcılığı olmayan, BMGK‟nin kendi rolü olarak üstlendiği Koruma Sorumluluğu olgusunda Uluslararası Ceza Mahkemesi‟ne de atıflarda bulunmaktadır.
History has become witness to horrible crimes throughout the years and could not be just enough towards these crimes for violations of rights. First permanent court for crimes was settled by the participation of 160 countries after a very passive period which Cold War has brought into the international system. The International Criminal Court (ICC) was established at the end of 20.century and became more effective in the 21.century as a product of a common global commitment. The establishment of Nuremberg and Tokyo Courts in conjunction with the Second World War set a precedent to the system. ICC has consequential value in the sense of being international.
Particularly, in 21.century with the examination thoroughly of the human rights more have made ICC greater extent competent and important. Hence, ICC assuming the role of deterrence where many different regional powers move on under the same anarchic system with trying to ensure a common framework with the support of governments and international organizations has been supported by all of actors. In accordance with the role assumed by Criminal Court seeks more states to be part of The Criminal Court. For that purpose, The Criminal Court is located in the heart of the global movement to suppress impunity. Thus the ICC, as an independent mechanism than The United Nations especially get involves where any state is not adequate for judgment in itself. At this stage the ICC takes part in issue to provide peace and justice. The absence of central authority, separations and internal conflicts can be utilized in return of colonialism. In other words, mostly human right abuses and lack of authorities can explain the presence of current African cases in ICC. Moreover, Georgia and South Korea cases are currently being followed which shows the effort of ICC to be more universal throughout the world.
The ICC has established with a structure of bottom-up. In this sense, states are the first responsible and concessionaire bodies. Thus, no solution can be found unless states give commitment to work in common framework. States that are composing the majority of the world‟s population are not party to the ICC. However, the ICC would be able to expand its jurisdiction with the support of party states and weaken the basis of new possible crimes in the system.
