İslam hukuku ve içtihatında kürtaj suçu ile ilgili hükümler, hukukçuların görüşleri
ve muhakeme ve değerlendirmedeki davranışları ve aşağıdaki karşılaştırmaları incelemek

Bu çalışmada, Yahudi, Hıristiyan ve İslam hukukunda kürtajla ilgili hüküm
açıklanmaktadır. Bu yasaların her birinin kürtaja karşı olup cezalandırdığını görüyoruz.
İslam hukukunda, hukukçuların ruh üflenmesinin öncesi ve sonrası aşamada gerçekleşen
kürtajı birbirinden ayırdıkları için, hukukçuların konuyla ilgili görüşleri tartışıldı.
Alimlerin çoğu, ruh üflenmesinden sonraki aşamada yasak olduğu görüşündedir. Ruh
üflenmesinden önceki aşamada farklılaştılar ve farklılıkları ele alınmıştır.
İslam hukukunda kürtaj cezasından da bahsedilmiş ve İslam'ın bu suçun unsurları
ve şartları yerine getirilmesi halinde işlenmesi gerektiğine karar verdiğini anlıyoruz.

The provisions on abortion crime in Islamic law and jurisprudence, the views of
jurists and their behavior in judgment and evaluation, and the following comparisons have
emerged with this study: We can summarize this as follows:
In the first part, we discussed the conversation about the definition of crime in modern
law and Islamic law. It is explained that what is meant by abortion crime is the termination
of pregnancy or what happens in the woman's womb, ending with an act of herself or others
before completing the pregnancy.
All the definitions we have mentioned require the fetus to leave the uterus and exit from
it. We discussed the definition of abortion in both medical science and law terms.
Talking about the distinction between abortion and contraception, we expressed it
as follows: Preventing pregnancy before it takes place is not abortion. Because abortion is
supposed to follow pregnancy whose growth and development ceases.
While talking about the distinction between abortion and murder, we said: The
victim of abortion is the fetus. In the second crime, the victim is a living person. Also,
some of the reasons that lead to abortion have been explained.
The provisions regarding abortion in Judaism, Christianity and Islam were
discussed. It was clear that, all these religions abhor and punish the act of abortion. In
Islamic law, the views of the jurists are discussed on the subject, as they differentiate
between abortion before and after the soul is breathed into the fetus. Most scholars are of
the opinion that it is forbidden in the stage after the soul is breathed into the fetus.
The punishment for abortion within the framework of the Islamic law are
elaborated and here, it is established that in certain situations Islam does permits abortion
while discretionary abortion is outrightly prohibited. Regarding punishment for abortion,

it is shown that the scholars differed in the amount of gurra and differed on the obligation
of penance, and the differences between these are discussed.
The position of man-made laws and the different views of philosophers and lawyers
about abortion are also evaluated. It is discovered that while some supported it if it is done
with the consent of the pregnant woman, some discouraged it even if it was with the
consent of the pregnant woman, except in cases of necessity, as in Ivorian law.
We tried to compare Sharia and law in two aspects in abortion crime:
First: From the therapeutic point of view: In this respect, we have considered the
comparison in three ways:
a) Medical abortion
b) Abortion for fetal reasons
c) C abortion for economic and social reasons
Second: In terms of penalty: In this respect, we saw the difference between sharia
and law in terms of punishment.
In this research, it is noted that the Ivorian law, unlike Islamic law, did not discuss
the spiritual aspect of abortion, but rather punishes everyone who aborts a fetus. However,
the Ivorian law does not provide a precise definition for abortion like that in the Islamic
law
