Vergi, geçmişten günümüze kamu finansmanını sağlamak için kullanılan ve ilk
akla gelen en temel kaynaktır. Devlet egemenlik gücüne dayanarak vatandaşlardan
vergi toplar. Bu vergiler cebren ve karşılıksız olan ekonomik değerlerdir. Vergi sistemi
sosyal ekonomik ve siyasal alanda meydana gelen değişken ve dinamik bir yapıya
sahiptir. Vergi idaresi ile mükellefler arasında ki uygulamadan doğan bazı
uyuşmazlıklar olabilmektedir. Bu uyuşmazlıklarda bir taraf mükellef diğer taraf ise
devlettir. Devlet mükelleften alacağı vergiyi kanunların öngördüğü şekilde toplayarak
vergi miktarını maksimize etmeye çalışmaktadır. Mükellef ise doğası gereği her zaman
daha az vergi vermeye gönüllüdür. Bu durum uyuşmazlıkların temel sebebidir.
Devletle mükellef arasında ortaya çıkan vergi uyuşmazlıkların vergi borçluları
tarafından ortadan kaldırılmak amacıyla bir takım çözüm yollarını başvurulmaktadır.
Bu araştırmada öncelikle vergi uyuşmazlığı ve vergi uyuşmazlığına neden olan
etkenlerden bahsedilmiş, uyuşmazlığın çözümüne ilişkin mükelleflerin izleyebileceği
yollar sıralanmıştır.
İdari aşamada çözüme kavuşturulan uyuşmazlıklar ile yargıya intikal eden
uyuşmazlıkların karşılaştırılması yapılmış ve Türk Vergi Yargısının etkinliğini azaltan
nedenlere değinilerek uygulamadaki zorlukların aşılması amacıyla öneriler
sunulmuştur
Tax is the most basic source used to provide public finance from the past to the
present. The state collects taxes from citizens based on the power of sovereignty. These
taxes are economic values that are imposed and unrequited. The tax system has a
dynamic and dynamic structure in the social and political spheres. There may be some
disputes arising from the practice of the tax administration and taxpayers. In these
disputes, one side is the payer and the other is the state. The state is trying to maximize
the amount of tax by collecting the tax that it will receive from the taxpayer as
stipulated by the laws. The taxpayer is, by its very nature, willing to pay less taxes at
all times. This is the main reason for disputes. The tax disputes between the state and
the taxpayers are resorted to by a number of remedies in order to eliminate tax debts.
In this study, firstly, the tax mismatches and the factors that cause tax disputes
are mentioned and the ways in which the taxpayers can solve the dispute are listed.
The disputes that have been resolved at the administrative stage and the
disputes that have been brought to the judiciary have been compared and the reasons
for decreasing the effectiveness of the Turkish Tax Judiciary have been addressed and
suggestions have been submitted to overcome the difficulties in implementation
