Toplumun temeli olan aile, önemini asırlar boyu korumuş, hiçbir sosyal sis tem ya da yaşam tarzı bu kurumu ortadan kaldırmamıştır. Aile, toplumla fert arasın da bir aracı rolü görmüştür. Ailenin varlığı insanlığın tarihi kadar eski olmakla bera ber onun yapısı, görev ve sorumlulukları itibariyle toplumdan topluma farklılık gös termiştir.
Tezimizde Cahiliye dönemi aile yapısıyla ilgili hadiseleri ve hükümleri İslam
hukukuyla bağlantılı olarak kronolojik bir şekilde incelemeye çalıştık. Yapılan araş tırmalar, Cahiliye döneminde Hicaz topraklarında ataerkil ve kadının ikinci planda
olduğu bir aile yapısı olduğunu göstermektedir. İslam’ın ortaya koyduğu aile yapısı
ise, kendine özgü birtakım ilkelere sahip olan ve belki de Kur’an’ın hakkında en çok
ayrıntı verdiği kurumdur. Bu da, aileye verilen önemin bir göstergesidir. Cahiliyede ki aile yapısından farklı olarak, İslam’da kurulan aile yuvası çok ciddi hukukî çerçe veye sahiptir. Evlilik (zevac) ve boşanma (talâk) konuları İslam hukukunda ayrıntılı
bir şekilde ele alınmıştır. Yapılan bu çalışmada ise, özellikle Cahiliye dönemindeki
evlilik ve boşanmaların İslamla beraber nasıl bir değişime uğradığı, ilga edilen, ibkâ
edilen ve ıslah edilen yönleri incelenip bunların İslam hukukundaki hükümlere nasıl
yansıdığının tespiti hedeflenmiştir
The family, which is the foundation of society, has maintained its importance
for centuries and no social system or lifestyle has abolished this institution. The fam ily saw an intermediary role between the community and the individual. Although
the existence of the family is as old as the history of mankind, its structure, duties
and responsibilities differed from society to society.
In our thesis, we tried to examine the events and provisions related to family
structure of Jahiliya period in chronological way in connection with Islamic law.
Researches show that in the period of Jahiliya, the patriarchal in the Hejaz lands and
the family structure of the woman in the second plan. The family structure revealed
by Islam is the institution that has its own principles and perhaps it which Qur'an
gives the most details about. This is an indication of the importance given to the fam ily.
Unlike the family structure in Jahiliya, the family in Islam has a very serious
legal framework. The subjects of marriage (zavac) and divorce (talâk) issues are dis cussed in detail in Islamic law. In this study especially, it has been aimed to deter mine how the marriage and divorce in the Jahiliyya period has changed with Islam,
and the removed (ilqa), released (İbqa) and corrected (islah) aspects of the provisions
are examined and how they are reflected in the provisions of Islamic law
