Birleşmiş Milletler Antlaşmasının kabulü ile birlikte devletlerin kuvvet kullanması ve kuvvet kullanma tehdidinde bulunması yasaklanmıştır. BM Antlaşması sadece bireysel ve müşterek meşru müdafaa durumlarında kuvvet kullanımına izin vermiştir. Bu çerçevede meşru müdafaa hakkı antlaşmanın 51. maddesinde düzenlenmiştir. Bu maddede yer alan silahlı saldırı ve doğal hak kavramlarının devletler tarafından geniş ve dar yorumlanması neticesinde meşru müdafaa hakkının içeriği de değişmiştir. Diğer yandan, savaşların biçim değiştirmesi ve bireye verilen önemin artması sonucu yeni düzenlemeler ortaya çıkmıştır. Bu düzenlemeler; önleyici meşru müdafaa, insani müdahale, koruma sorumluluğu ve devlet vatandaşlarının ülke dışında korunmasını içermektedir.
Bu çalışma, meşru müdafaanın değişen içeriği sonucu ortaya çıkan bu düzenlemeleri incelemektedir. Her düzenlemenin içeriği ve örnekleri ele alınmaktadır. Ayrıca bu çalışma, Gürcistan- Rusya, Ukrayna- Rusya ve Filistin- İsrail olay incelemelerini meşru müdafaa çerçevesinde analiz etmektedir. Bunu yaparken, özellikle devletlerin müdahale gerekçeleri üzerinde durmakta, meşru olmayan durumları belirtmekte ve uluslararası toplumun tepkisini incelemektedir. Bu tez, uluslararası toplumun tepkisini ele alarak meşru olmayan durumların uluslararası topluma nasıl kabul ettirildiğini ortaya koymaktır. Ayrıca sonuç bölümündeki dört tablo tezin planını da ortaya koymaktadır. Her olay incelemesi müdahale gerekçeleri, meşru olmayan durumlar ve uluslararası toplumun tepkisi çerçevesinde analiz edilmektedir.
With the acceptance of United Nations treaty, it is forbidden for states to use and threat to use of force. UN treaty allows the use of force only in case of individual and collective self defense. In this framework, the right of self defense is regulated in treaty’s article number 51. In order not to result in any misinterpretation by states, the concepts of the right of self defense also subject to change. On the other hand, as a result of changing format of war and increased emphasis on the individual new regulations have emerged. These regulations include preventive self defense, humanitarian intervention, responsibility to protect and the protection of citizens abroad.
This study examines the regulations emerging as a result of the changing content of self defense. Each regulation of content and examples are discussed. Furthermore, this study has analyzed Georgia- Russia, Ukraine- Russia and Palestine- Israel case studies in the framework of self defense. By analyzing the cases, the study focuses on the reasons for the intervention of the states, noting illegitimate situations are made to be accepted by international community by addressing the responses of them. In addition, the four charts in the conclusion part of the thesis shows the design of the research. Each case study is analyzed in the framework of reasons of intervention, illegitimate situations and the response of the international community.
